Bylaws - Article 23:00
 
Section 1: Whatever the rights and privileges of one member shall be the rights and privileges of all members in good standing in the Local Union, except as otherwise provided in the Constitution.
 
Section 2: If members are in doubt about the application of the By-laws or Working Rules, they should contact the District Office.  Ignorance of the Constitutions Ritual or By-laws shall not be considered an excuse for any violation and any violation of any of the Constitution Ritual, By-Laws or Working Rules shall be punishable by a fine not exceeding ten thousand ($10,000.00) dollars, expulsion or both as the authority of the Local Union may direct.
  1. The principle of first in, first out shall be adhered to in each respective classification and each member will be issued a dispatch number.   Name hire request will be as per the appropriate Collective Agreement.  Effective November 1st, 1998, the Local Union shall not allow a Contractor to name hire from the Local Union’s out-of-work list any member who holds membership in, or provides services to a competitive Union and the member will not be eligible for name hire for a period of six (6) months.  This provision shall also apply to any member who has, within eight (8) months, worked through or paid dues to a competitive Union on work that falls within the scope of work normally performed by the membership of Local 955.  Effective May 1st, 1998 a member who is designated a “salt” by the Union for the purposes of an organizing drive, sanctioned by the Executive Board, shall be exempt from this provision.
  1. Members shall register their name on the out-of-work list and then shall report once a month either by phone or in writing.  Out-of-town members can send a post card to their district office.  Failure to report may result in your name being removed from the list.
  1. Members going to work when not dispatched from the Union Office shall notify the office accordingly and shall state the name of the Employer, the rate of pay and conditions they will receive and such other pertinent information as may be required.
  1. Any member refusing three (3) consecutive jobs when called or not being available when called for jobs three (3) consecutive times shall be suspended from the out-of-work list unless just cause is shown or stipulations are given by the member registering on the list.

In the event of a dispute the members shall refer their case to the Executive Board which shall determine whether extenuating circumstances prevail or not.

  1. Where members are reported as incompetent three (3) consecutive times, they shall be requested to explain their actions to the Executive Board and may be requested to revise the qualifications on their work card.
  1. Where members go to work from one (1) to fourteen (14) working days they shall, when laid off, go back on the out-of-work list at their original position.  On jobs of over fourteen (14) working days a member shall be considered employed and will go to the bottom of the out-of-work list when laid off.
  1. Suspended members shall be removed from the out-of-work list.
Section 3: Members shall not accept work without notifying the district office in which the work is located.  This shall not, however apply to members who move with an Employer in the performance of their work, provided they notify the district office to which they are transferred by the Employer.
 
Section 4: No member shall take over the job of another member who has been unjustly dismissed.  Intoxication, negligence or incompetence shall be considered "just cause" for dismissal.  Members have the right to retain their position pending investigation of their dismissal.
 
Section 5: No member shall enter into a private contract of employment which serves to break down the established wage rates or working conditions of this Local Union.
Section 6: All members shall become familiar with the Safety Rules as established by the Occupational Health and Safety Act.
 
Section 7: Apprentice Engineers (oilers and mechanics' helpers) will be required to work under the supervision of a journeyman engineer or as designated by the Provincial Apprenticeship and Industry Training Act.
 
Section 8: No member shall teach a person who is not a member to operate or repair machines coming under the jurisdiction of this Union .
 
Section 9: All journeyman engineers shall make every effort to see that an apprentice (oiler) is employed while operating shovels, backhoes, draglines, ditching machines and such other equipment as may require the employment of apprentices.  Mechanics' helpers (apprentices) shall be employed in accordance with such ratio as may be established by the Provincial Apprenticeship Board.
 
Section 10: The employment of master mechanics and equipment foremen, wherever necessary, is encouraged and all members should make every effort to qualify for this responsible position and upon becoming qualified shall notify the dispatch office.
 
Section 11: Master mechanics and foremen of the trade who are Union members shall employ only Union members as long as such members are available, and shall assist in organizing such engineers and apprentices coming under their supervision.
 
Section 12:
  1. All members shall secure dispatch slips upon commencing employment from the dispatch office unless advised by the dispatch office that their dispatch slip has been sent by facsimile, and shall be paid up to date before such dispatch slip will be issued, unless given permission by the district representative.
  1. Members who accept referral slips for employment and fail to report to work on the date required shall be assessed one hundred dollars ($100.00), which shall be paid prior to having their name replaced on the bottom of the list.
Section 13: Members shall at all times carry their membership cards for ready inspection by representatives, officers or job stewards and shall also present such cards in order to be admitted to membership meetings.
 
Section 14: Identification crests (such as hard hat stickers) will be provided to each member.
 
Section 15: Members are responsible for keeping the dispatch office advised of their qualifications when reporting on the out-of-work list.
 
Section 16: Members remitting dues by mail shall make all cheques or money orders payable to Local 955, International Union of Operating Engineers.  Personal cheques will be accepted; however any notification by the bank that such cheque is not in order will automatically cancel payments made in this manner.  Dues cards shall accompany any payments made by mail so that they can be stamped up to date and returned to the member.
